Hostage-taking and kidnapping - contrary to shariah?

Muslims living in and addressing the West seek to present Islam in the best

light and claim that kidnapping and hostage-taking are contrary to
shariah. 
It is claimed that this is especially so when foreigners holding visas
from 
Muslim governments are involved.It is said that kidnapping innocent people

and civilians is also forbidden.

What these apologists omit to say (taqiyya again) is that during times of 
war such practices are legitimate, though when challenged they concede
this. 
Islamists, of course, argue that the umma is in a state of jihad against 
corrupt infidel governments, and therefore kidnapping and hostage-taking, 
according to Muhammad's own example in war, are legitimate. They further 
argue that in modern warfare there are no innocent civilians because they 
sup****t the infidel governments by voting in elections and paying taxes. 
(They forget about infants and children, the many who do not vote, and
those 
who vote against their governments.)

Bin Laden argues in the same way:

"It is a fundamental principle of any democracy that the people choose
their 
leaders, and as such, approve and are party to the actions of their
elected 
leaders... By electing these leaders, the American people  have given
their 
consent to the incarceration of the Palestinian people, the demolition of 
Palestinian homes and the slaughter of the children of Iraq. That is why
the 
American people are not innocent. The American people are active members
in 
all these crimes.
